Welcome to Lillavie! The terms “we,” “us,” and “our” refer to Lillavie.
Lillavie operates this online store and related services, including all information, functions, products, and tools (collectively, the “Services”), to provide you with a carefully curated shopping experience.
Our store is powered by Shopify, which enables us to offer our Services safely and efficiently.

By visiting our website, placing an order, or using our Services, you agree to these Terms and Conditions and our Privacy Policy. Please read these Terms carefully before using our website.

1. Applicability

These Terms apply to every offer made by Lillavie and to every contract concluded between Lillavie and you, the consumer, through our online store.
Any deviations from these Terms are valid only if confirmed by us in writing.

2. Orders and Conclusion of the Contract

A purchase agreement is concluded once you have placed an order through our webshop and we have confirmed it in writing (via email).
We reserve the right to refuse orders, for example in cases of payment issues, suspected fraud, or product unavailability.

You are responsible for providing accurate and complete information when placing an order.
Delays or issues resulting from incorrect or incomplete information are at your own risk.

3. Prices and Payment

All prices on our website are listed in euros (€), including VAT and excluding shipping costs (unless otherwise stated).
Shipping costs will be clearly displayed during the checkout process.

Payment must be made using one of the payment methods offered by Lillavie.
Orders will only be processed once payment has been received.

We reserve the right to change prices at any time. Price changes do not affect confirmed orders.

4. Delivery and Shipping

We do our best to process and ship your order as quickly as possible.
All stated delivery times are estimates and not binding.
We are not liable for delays caused by postal or courier services or by circumstances beyond our control.

The risk of loss or damage passes to you once the order has been received by you or a third party designated by you (other than the carrier).

5. Right of Withdrawal (Cooling-Off Period)

You have the right to withdraw from your purchase within 14 days of receiving your order, without providing any reason.
During this period, you must handle the product and its packaging with care and only inspect it as you would in a physical store.

To exercise your right of withdrawal, please email us at info@lillavie.com with your cancellation request. You will receive instructions for returning the products.

Exceptions:
The right of withdrawal does not apply to:

  • Personalized or custom-made products;

  • Products that cannot be returned for hygiene reasons (such as worn baby clothing or opened toy packaging).

Return shipping costs are the responsibility of the customer unless otherwise agreed.
We will refund the purchase amount (including standard delivery costs) within 14 days after receiving the returned items, provided that the products are returned in their original condition.

6. Warranty and Conformity

We guarantee that our products comply with the agreement, the specifications stated in the offer, and reasonable standards of quality and usability.

If a product does not conform to the agreement, you are entitled to repair, replacement, or—if that is not possible—a refund of the purchase price.

The statutory warranty period for consumers within the EU is a minimum of two years, unless the nature of the product makes this unreasonable.

7. Product Safety & Toy Disclaimer

Our products are designed and inspected with the utmost care for quality and safety.
However, toy products must always be used under adult supervision.

Some toys may contain small parts or detachable components that could pose a choking or injury risk to young children.

Customers are responsible for:

  • Carefully inspecting toys before use;

  • Removing any loose or detachable parts that could be unsafe; and

  • Supervising children at all times during play.

By purchasing or using toy products from Lillavie, you acknowledge that use of these products is at your own risk.
Lillavie cannot be held liable for injury, harm, or damage resulting from misuse, lack of supervision, or failure to follow safety instructions.

Always follow the age recommendations indicated on the packaging and regularly check toys for wear or damage.

8. Intellectual Property

All texts, designs, photos, logos, and other content on our website are owned by Lillavie or its licensors and are protected by copyright and other intellectual property laws.
You may not copy, distribute, or otherwise use any materials from our website without our prior written consent.

9. Liability

We accept no liability for indirect or consequential damages, or for loss of profit.
Our liability is limited to the value of the product purchased, unless the damage results from intent or gross negligence.
Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence.

10. Complaints Procedure

If you have a complaint about our products or services, please contact us first at info@lillavie.com.
We aim to respond to all complaints within 14 days of receipt.

If we cannot resolve the issue together, you may submit your complaint to the Webshop Disputes Committee (www.degeschillencommissie.nl)
or through the European Online Dispute Resolution (ODR) Platform:

11. Force Majeure

We are not liable for any delay or failure to perform our obligations if caused by circumstances beyond our reasonable control, including but not limited to strikes, natural disasters, pandemics, transport disruptions, or government actions.

12. Governing Law

These Terms and any related agreements are governed exclusively by Dutch law.
Any disputes will be submitted to the competent court in the district where Lillavie is established, unless mandatory law provides otherwise.
